Electronic Health Records

Electronic health records have become an important aspect of business for most healthcare providers, and Hancock Daniel has experience in managing an array of legal issues relating to EHR/EMR. Hancock Daniel regularly advises clients regarding contracts for purchasing EHR systems (both directly from EHR vendors, as well as preparing agreements to comply with the Stark standards for EHR donations), implementation of EHR, standards for access to EHR, obtaining financial incentives for meaningful use of EHR (and avoiding penalties for failure to achieve meaningful use), and development of and participation in health information exchanges. Hancock Daniel’s work includes preparing policies and procedures to meet regulatory requirements impacting EHR systems, assistance relating to privacy and security requirements impacting EHR, and assistance in management of breaches of protected health information involving EHR. Hancock Daniel’s experience includes representation of hospitals and health systems, physician practices, laboratories, DME suppliers, nursing homes and other post-acute care providers, home health providers, hospice providers, and assisted living facilities.
