CMS UPDATES ABN FORM

August 6, 2020

The Office of Management and Budget renewedthe Centers for Medicare and Medicaid Services’ (CMS) instructions and Advance Notice of Noncoverage (ABN), Form CMS-R-131, which is distributed by providers, physicians, practitioners, and suppliers to Medicare beneficiaries under circumstances when Medicare payment is expected to be denied. The ABN is issued in order to transfer potential financial liability to the Medicare beneficiary.

Due to COVID-19 concerns, CMS has expanded the deadline for use of the renewed ABN, Form CMS-R-131 (exp. 6/30/2023). At this time, the renewed ABN will be mandatory for use on 1/1/2021. The renewed form may be implemented prior to the mandatory deadline. The renewed ABN form and instructions may be found here.

If you have any questions or concerns regarding the implementation of ABN, Form CMS-R-131 or its instructions, please contact a member of Hancock Daniel’s Compliance team.
