The Emergency Medical Treatment and Active Labor Act (EMTALA) has changed significantly over its more than 40 year history. Since the COVID-19 pandemic, the survey activity in response to EMTALA complaints has continued to grow and state survey agencies have increasing pressure from CMS to strictly enforce EMTALA requirements. Compliance with all of the requirements of EMTALA in a busy emergency department is challenging, particularly in connection with the treatment of behavioral health patients and obstetrical patients. In addition, the time allotted to respond to survey findings is tight, with immediate jeopardy (IJ) citations requiring on-the-spot responses. HDJ is available to guide hospitals and physicians through EMTALA challenges by providing support on all fronts with the immediacy and efficiency necessary to bring hospitals back into compliance as quickly and efficiently as possible.
